These Terms of Use (“Terms”) govern your access to and use of photomaxxing.com (the “Service”), operated by PhotoMaxxing (“we”, “us”, or “our”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. The Service in plain language
PhotoMaxxing is a safe-for-work photo-feedback service and two-sided marketplace. Customers upload photos of themselves and pay a one-time fee to receive a structured review from an independent reviewer. A review consists of a keep/cut verdict on each photo, written notes, a short audio walkthrough recorded by the reviewer, and a recommendation of the customer's strongest photo. PhotoMaxxing operates the platform, processes payments, moderates content, enforces these Terms, and pays reviewers a service fee net of our platform fee. We do not author the reviews ourselves.
PhotoMaxxing is not a dating, matchmaking, or introduction service. There is no messaging or contact between users. It is a feedback utility only.
2. Eligibility
You must be 18 or older to use the Service — customers and reviewers alike. By using the Service, you represent that you meet this requirement and have the legal capacity to enter into these Terms.
3. Account registration
You agree to:
- Provide accurate and complete information
- Maintain the security of your account credentials
- Notify us immediately of any unauthorised access
- Take responsibility for all activity under your account
We reserve the right to suspend or terminate accounts that violate these Terms.
4. Acceptable use and content
The Service is strictly safe-for-work. You may upload photos of yourself only, the content must be non-sexual and appropriate for a public profile, and you must be 18 or older. Sexual, explicit, suggestive, or otherwise prohibited content is never permitted and results in immediate and permanent banning. Your use of the Service is governed by our Acceptable Use & Content Policy, which is incorporated into these Terms.
5. Payments, fees, and refunds
Customers pay a one-time fee per review, shown in US dollars at checkout. The price is set by the assigned reviewer and is recomputed server-side at the moment of payment to prevent tampering.
Platform fee.PhotoMaxxing retains a platform fee from each completed review; the remainder is the reviewer's service fee. The platform fee covers payment processing, hosting, moderation, support, and continued development of the Service.
Payment processor.All payments are processed by Stripe. By paying for a review, you also agree to Stripe's terms.
Refunds and cancellations. Our Refund & Cancellation Policy forms part of these Terms. In summary: you may cancel for a full refund any time before your review is delivered, and you may request a refund within 7 days of delivery if a review does not work or violates our content policy. When a refund is granted, the full amount, including the platform fee, is refunded.
Reviewer payouts. Reviewers are independent and are paid their service fee via Stripe Connect once identity verification is complete. Payout cadence and minimums are described in the reviewer dashboard.
6. Intellectual property
6.1 Our content
The Service, including its design, code, and the PhotoMaxxing wordmark, is owned by us or our licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service in accordance with these Terms.
6.2 Reviewer recordings
Reviewers retain copyright to the audio recordings and notes they produce. By submitting a review, the reviewer grants PhotoMaxxing a non-exclusive, royalty-free licence to host, store, and deliver the review to the customer who paid for it, and grants PhotoMaxxing the right to moderate, redact, or remove content that violates these Terms. We do not use reviewer recordings for marketing or model training without the reviewer's explicit consent.
6.3 Customer photos and content
Customers retain ownership of the photos and any content they upload. By submitting an order, the customer grants PhotoMaxxing and the assigned reviewer a non-exclusive, royalty-free licence to host and view the uploaded material solely to fulfil and deliver the review. Customer photos are not shown publicly, are seen only by the assigned reviewer, and are not used for marketing, model training, or any dating, romantic, or third-party purpose.
7. Privacy
Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to our processing of information as described there.
8. Termination
You may close your account at any time by emailing hi@photomaxxing.com. We may suspend or terminate access to the Service for violation of these Terms or our Acceptable Use Policy, for non-payment or chargeback fraud, if required by law, or for any reason with reasonable notice. Upon termination, your right to use the Service ceases immediately; sections that by their nature should survive remain in effect.
9. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. Reviews are subjective opinions. We do not warrant that a review will improve match rates, engagement, or any other outcome. The value of a review is the reviewer's honest perspective, not a guarantee of results.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM OR (B) USD $100.
11. Indemnification
You agree to indemnify and hold us harmless from any claims, losses, or damages (including legal fees) arising from your violation of these Terms or any law or third-party right, or from the content you upload.
12. Governing law
These Terms are governed by the laws of the State of Wyoming, United States, without regard to conflict-of-laws principles. Disputes will be resolved in the state or federal courts located in Wyoming, USA, unless otherwise required by law.
13. Changes to these Terms
We may update these Terms. We will post the updated Terms at photomaxxing.com/terms and update the “Last updated” date. Continued use of the Service after changes constitutes acceptance.
